Terms & Conditions

These Terms and Conditions govern access to and use of climbsunday.com, as well as the booking and purchase of tourism services offered by CLIMB SUNDAY E.I.R.L., operating under the Climb Sunday brand.

Before making a booking, travelers must review the information applicable to the selected service, including the itinerary, duration, price, included and excluded services, requirements, cancellation conditions, and any specific terms communicated before purchase.

By confirming a booking and/or making a payment, the traveler acknowledges that they have received and reviewed the applicable service information and accepts these Terms and Conditions, together with any specific conditions imposed by third-party providers that were disclosed before confirmation.

Nothing in these Terms and Conditions excludes or limits any rights granted to consumers under applicable Peruvian law.

2. Tour and Service Information

Climb Sunday offers tours, excursions, travel programs, and tourism experiences within Peru.

Each tour page contains specific information about the service offered, which may include the itinerary, duration, destinations visited, included and excluded services, recommendations, requirements, particular conditions, and price.

Travelers are responsible for reviewing this information before booking.

Where a particular service is subject to specific conditions related to entrance tickets, hotels, trains, flights, transportation, permits, or other third-party suppliers, those conditions will be communicated before confirmation and will supplement these Terms and Conditions.

3. Availability Check Before Booking

Before completing a booking through the Booking system on climbsunday.com, travelers must contact Climb Sunday directly via WhatsApp to confirm availability for their preferred travel date, using the contact channel indicated on the relevant tour page.

The appearance of a date within the Booking system does not, by itself, constitute a guarantee or final confirmation of availability.

Once Climb Sunday has initially confirmed availability, the traveler may proceed with the online booking and payment process.

Certain services, particularly Machu Picchu tours, as well as services involving nominative entrance tickets, train tickets, accommodation, transportation, permits, or other third-party services, remain subject to actual availability at the time the reservation is processed.

4. Booking and Confirmation

Tours enabled for online booking include a Booking button through which travelers can begin the reservation process.

After checking availability with Climb Sunday, the traveler must complete the requested information, select the corresponding date, and pay 100% of the price of the selected service.

The current online booking system does not offer partial payments, deposits, or advance-payment options.

Payment alone does not necessarily constitute immediate confirmation of all requested services when those services depend on third-party availability.

Climb Sunday will verify the required availability and subsequently communicate the booking confirmation to the traveler.

If a requested service is unavailable after payment has been made, Climb Sunday will inform the traveler and may offer an alternative date, an equivalent service, or another available option. Where the booked service cannot be provided, any refund due will be handled in accordance with these Terms and Conditions, the specific conditions applicable to the service, and applicable law.

5. Prices and Currency

Prices published by Climb Sunday are expressed in United States Dollars (USD), as indicated in each tour, travel program, or quotation.

The total price payable will be communicated to the traveler before the booking is confirmed.

Where applicable, the price may include Peruvian General Sales Tax (IGV), as well as applicable taxes, fees, entrance tickets, commissions, administrative charges, and other items included in the contracted service.

Before payment, Climb Sunday will inform the traveler of the main services and items included and excluded from the price.

Any item not included in the tour description or quotation, including optional services, personal expenses, gratuities, entrance fees, or services expressly identified as excluded, will be the responsibility of the traveler.

Climb Sunday will not apply additional charges that should have been disclosed before booking without first informing the traveler.

If payment is made using a card, bank account, or payment method denominated in a currency other than USD, the traveler’s bank, card issuer, or financial institution may apply its own exchange rate, conversion fees, or other charges. Such charges are determined by the relevant financial institution and not by Climb Sunday.

6. Payment Policy

Bookings made through climbsunday.com require full payment of 100% of the price of the selected service.

For online bookings, Climb Sunday uses Mercado Pago as an external payment-processing provider.

Payment approval is subject to the validations performed by Mercado Pago and/or the traveler’s financial institution.

If a transaction remains pending, is rejected, cancelled, or is not successfully completed, the booking will not be considered paid or confirmed.

Climb Sunday does not request or directly store full card numbers, CVV security codes, or online banking passwords through its website checkout.

7. Traveler Cancellation Policy

When a traveler requests cancellation of a booking, the following general Climb Sunday cancellation policy applies:

  • 30 days or more before the service date: 100% refund of the amount effectively paid.
  • 15 to 29 days before the service date: 70% refund.
  • 8 to 14 days before the service date: 50% refund.
  • 4 to 7 days before the service date: 25% refund.
  • More than 72 hours but less than 4 days before the service date: no refund.
  • From 48 hours up to and including 72 hours before the service date: no refund, unless the applicable supplier conditions allow a refund, rescheduling, or travel credit.
  • Less than 48 hours before the service date: no refund.
  • No Show: no refund.

These percentages constitute Climb Sunday’s general cancellation policy.

Different conditions may apply when a booked service is subject to specific cancellation, penalty, amendment, or non-refundable conditions imposed by a third-party supplier.

Any such specific conditions will be communicated to the traveler before the booking is confirmed.

Refund calculations will take into account the conditions previously disclosed to the traveler and any amounts that are effectively recoverable.

8. Administrative Charges

Where applicable, Climb Sunday may charge an administrative fee for costs associated with managing, modifying, or cancelling a booking.

Any applicable administrative charge will be communicated to the traveler before confirmation and will be clearly identified in the quotation, booking documentation, confirmation, or other applicable document.

No administrative charge that should reasonably have been disclosed before booking will be applied without prior notification to the traveler.

9. Refund Policy

Where a refund is due, Climb Sunday will process the refund within a maximum period of fifteen (15) business days, counted from the approval of the refund and, where applicable, once the amounts due have been returned by the suppliers involved.

If the refund depends on a third-party supplier and that supplier requires additional processing time, Climb Sunday will inform the traveler accordingly.

The final refundable amount will be determined according to the applicable cancellation policy, services already provided, supplier conditions previously disclosed to the traveler, and any amounts that are effectively non-recoverable.

10. Refund Method

Refunds will preferably be made through the same payment method originally used by the traveler.

If this is not technically possible, Climb Sunday may coordinate an alternative refund method with the traveler.

Any applicable banking or transaction fees associated with the refund will be communicated to the traveler when relevant.

Once Climb Sunday has processed the refund, the time required for the funds to appear in the traveler’s account may depend on Mercado Pago, banks, card issuers, or other financial institutions.

11. Non-Refundable Services

Certain tourism services may be subject to non-refundable conditions established by third-party suppliers.

Depending on the service booked, this may include entrance tickets, transportation tickets, accommodation reservations, excursions, transportation services, permits, or other services purchased in advance.

Before payment is made, the traveler will be informed when a particular service is subject to a non-refundable condition.

Once a service that has been clearly identified as non-refundable has been confirmed and paid for, the corresponding amount will not be refundable unless the relevant supplier expressly authorizes a refund or applicable law requires a different solution.

Management fees, commissions, and other charges that have actually been incurred and cannot be recovered may also be non-refundable where this condition has been disclosed in advance and is applicable.

12. Rescheduling and Date Changes

Requests to change a travel date must be made at least thirty (30) days before the originally scheduled service date.

All rescheduling requests are subject to availability and to the conditions established by the suppliers involved.

A change may result in fare differences, penalties, administrative fees, or other additional costs. Any applicable amounts will be communicated to the traveler before the change is processed.

Climb Sunday will manage the request with the relevant suppliers but cannot guarantee approval where the decision depends on a third party.

13. Change of Traveler

Changing the passenger name or transferring a booking to another person will be subject to the nature of the booked service and the conditions established by the applicable suppliers.

Where a change is permitted, the traveler must request it with sufficient notice and provide any documentation required.

Any fare difference, penalty, administrative fee, or additional cost resulting from the change will be communicated and will be payable by the traveler where applicable.

Nominative services and services whose conditions do not allow a change of passenger cannot be transferred to another person.

14. No Show

A No Show occurs when the traveler fails to appear at the agreed location, date, and time for the service without having previously completed a cancellation or modification accepted by Climb Sunday and/or the relevant supplier.

In the event of a No Show, the booking may be considered used or cancelled and, as a general rule, will not be eligible for a full or partial refund, unless the specific supplier conditions or applicable law provide otherwise.

This policy may apply to hotels, tours, excursions, transportation, entrance tickets, and other tourism services.

15. Punctuality and Waiting Time

Travelers must arrive at the meeting or pick-up point with the advance notice communicated by Climb Sunday and/or the applicable service provider.

As a general operational reference, excursions, transfers, and other activities may have an approximate waiting tolerance of 10 to 15 minutes, depending on the specific service.

Any specific meeting time and waiting period communicated for a particular service will prevail over this general reference.

Once the applicable waiting period has expired, the traveler may be considered a No Show where the operational conditions or supplier rules so provide.

The traveler is responsible for complying with all communicated schedules and meeting points.

16. Changes or Cancellations by Climb Sunday

Climb Sunday may modify, reschedule, suspend, or cancel a service when operational, safety, availability, or external circumstances make it reasonably impossible to provide the service under the originally planned conditions.

Where a service cannot be provided due to a cause directly attributable to Climb Sunday, the traveler will be informed and an appropriate solution will be offered in accordance with the circumstances and applicable law.

Depending on the circumstances, available solutions may include rescheduling, an equivalent service, or the corresponding refund.

17. Itinerary Changes

Due to the nature of tourism services, itineraries may need to be modified when reasonably necessary because of weather conditions, road closures, access restrictions, temporary closure of tourist attractions, social conflicts, instructions from authorities, safety considerations, or other operational contingencies.

When a change is necessary, Climb Sunday will make reasonable efforts to preserve the main characteristics and essential value of the contracted service.

Relevant changes will be communicated to the traveler as soon as reasonably possible.

18. Force Majeure and Extraordinary Circumstances

Climb Sunday and the suppliers involved may modify, reschedule, suspend, or cancel a service when force majeure or unforeseeable or unavoidable circumstances prevent or significantly affect its performance.

Such circumstances may include, as applicable, natural events, adverse weather conditions, roadblocks, social conflicts, government measures, emergencies, access restrictions, closure of tourist attractions, security issues, or other events beyond Climb Sunday’s reasonable control.

In these cases, Climb Sunday will coordinate with the relevant suppliers to identify the alternatives available.

Depending on the circumstances and the amounts effectively recoverable from suppliers, available solutions may include rescheduling, travel credit, a change of service, or a refund.

Additional expenses resulting from force majeure or extraordinary circumstances that fall outside the contracted service may be borne by the traveler when they are not recoverable from or recognized by the relevant suppliers, without prejudice to any rights granted to consumers under applicable law.

19. Travel Credits

Where a supplier authorizes the issuance of a travel credit, the credit may only be used in accordance with the conditions, validity period, restrictions, and dates established for that credit.

A travel credit cannot be converted into cash where the applicable supplier conditions do not permit a cash refund.

The traveler is responsible for using the credit within its stated validity period.

Once the validity period expires, the credit may lose its value in accordance with the conditions previously communicated.

Any fare difference, penalty, or additional expense resulting from the use of the travel credit will be payable by the traveler where applicable and previously disclosed.

20. Special Requirements and Passenger Conditions

Before confirming a booking, travelers must inform Climb Sunday of any special requirement that may affect the delivery of the service, including mobility needs, special dietary requirements, baggage restrictions, travel with minors, elderly travelers, or other particular needs.

Climb Sunday will coordinate these requests with the relevant suppliers, but acceptance will depend on availability and the conditions applicable to each service.

Travelers must provide complete, accurate, and truthful information and submit any required documentation within the applicable deadlines.

Climb Sunday will not be responsible for consequences arising exclusively from incorrect, incomplete, or late information provided by the traveler, without prejudice to any responsibility that may legally apply to the agency.

21. Traveler Responsibilities

Travelers are responsible for verifying and complying with all requirements necessary to undertake their trip.

These may include personal identification, passports, visas, permits, immigration requirements, entry conditions, travel documents, schedules, and any other requirements established by authorities or suppliers.

Climb Sunday may provide guidance within the scope of the contracted services; however, travelers remain responsible for holding the documentation required for their particular circumstances.

Travelers must also follow reasonable safety instructions provided by Climb Sunday, guides, operators, authorities, and suppliers during the provision of the service.

22. Health, Safety, and Tourism Activities

Some tours may involve hiking, altitude, physical activity, uneven terrain, changing weather conditions, or other factors inherent to the destination and activity.

Travelers should reasonably assess whether their personal condition is suitable for the selected service and inform Climb Sunday in advance of any relevant requirement that may need to be considered.

Climb Sunday will apply reasonable safety measures appropriate to the service provided.

Where a particular tour has specific requirements related to age, physical condition, documentation, insurance, or other restrictions, these conditions will be communicated before confirmation of the booking.

23. Third-Party Suppliers

To provide the contracted services, Climb Sunday may work with railway companies, hotels, transportation companies, local tour operators, guides, entrance-ticket providers, restaurants, and other tourism suppliers.

The involvement of third-party suppliers does not exclude any responsibility that legally corresponds to Climb Sunday in connection with the services it offers.

Any third-party condition affecting cancellations, amendments, refunds, or use of a service will be communicated to the traveler when it is relevant to the booking decision.

24. Privacy and Personal Data

Personal data provided by users will be processed in accordance with the Climb Sunday Privacy and Personal Data Protection Policy, available at:

Personal data associated with forms, bookings, payments, and other digital channels will be processed in accordance with that Policy and applicable Peruvian data-protection law.

25. Website Use and Intellectual Property

Users agree to use climbsunday.com lawfully and not to engage in any activity that may compromise its operation, security, availability, or the rights of Climb Sunday or third parties.

Texts, photographs, designs, logos, graphics, itineraries, and other original content available on the website are protected by applicable intellectual-property laws and belong to Climb Sunday or are used with the appropriate authorization.

Such content may not be reproduced, modified, distributed, or commercially exploited without prior authorization from the relevant rights holder.

26. Complaints and Claims

Climb Sunday provides its customers and consumers with access to a Virtual Complaints Book, available at:

Travelers may use this mechanism to submit a complaint or claim relating to services provided by Climb Sunday.

Submitting a complaint or claim through the Virtual Complaints Book does not restrict any other rights or remedies available to consumers under Peruvian law, including the right to contact INDECOPI where applicable.

27. Applicable Law

These Terms and Conditions are governed by the laws of the Republic of Peru.

Any dispute will be handled in accordance with the procedures, dispute-resolution mechanisms, consumer rights, and jurisdiction established under applicable Peruvian law.

28. Changes to These Terms and Conditions

Climb Sunday may update these Terms and Conditions when its services, commercial processes, booking systems, suppliers, or applicable legal requirements change.

Updated Terms will apply to bookings made from the effective date of the new version.

Bookings confirmed before an update will remain subject to the Terms and Conditions accepted at the time of booking, unless a change is required by law or expressly agreed with the traveler.

The date of the most recent update will be displayed at the beginning of this page.
